Long-term

This is a ‘living document’, capturing what is currently being done, and/or actions that are planned – it will be updated as and when progress is made and as more actions are taken. It brings together a range of activities and work being carried out by various individuals and organisations and aims to co-ordinate and amplify the impact. If you think that something you are doing aligns with the themes of the action plan and you’d like to consider including it as one of these actions, please get in touch.

Short-term

Using the law to support people with a learning disability and autistic people who are experiencing delayed discharge from inpatient units to be discharged into the community with the right support

Progress:

    • A resource explaining what legal support might be needed to help someone whose discharge has been delayed has been produced by the CBF with support from the Legal Panel
    • A form setting out what information lawyers need to be able to take on a case, which can be used to help families to gather information before the case is referred to lawyers, has been produced

Next steps:

    • Mencap will be adapting the resource into accessible formats that can be used by people with a learning disability and autistic people

Medium-term

Raising awareness of the rights of children with a learning disability, and support family carers to understand and use these

Next steps:

    • Produce a guide on the rights and entitlements of children with learning disabilities and their families

Long-term

Exploring how the law can be used to challenge rights not being upheld

Progress:

    • Work is underway to identify areas where rights are not being upheld, and to identify actions that can be taken to use the law to uphold these rights
    • Barriers to using the law to uphold rights are being identified

Next steps:

    • If relevant/feasible, undertake actions identified in the previous section
    • Share and raise awareness of successes in using the law to challenge rights not being upheld (this may involve collecting examples of this occurring)
